What are the criteria for consideration for awarding the Advanced Laborer title by the People's Court in Vietnam?
Under Clause 1 Article 12 of Circular 01/2024/TT-TANDTC, the criteria for consideration for awarding the Advanced Laborer title by the People's Court in Vietnam are specified as follows:
- Successfully complete tasks or higher (the recognition of the level of task completion for individuals shall comply with the regulations of CPV, laws and the Supreme People's Court); complete or exceed emulation targets, have high quality and efficiency; for judges, well comply with the provisions of the Code of Ethics and Conduct of Judges in which the rate of judgments and decisions canceled or corrected due to subjective reasons does not exceed the rate prescribed by the Supreme People's Court;
- Comply well with the guidelines and policies of the Party and laws; have the spirit of self-reliance, unity, and mutual assistance, and actively participate in emulation movements and social activities;
- Actively study politics, culture, expertise and profession;
- Have ethics and healthy lifestyle.
In addition, Circular 01/2024/TT-TANDTC also stipulates the cases of annual consideration for awarding the Advanced Laborer title as follows:
- For individuals whose heatlh must be treated or nursed because of participating in combat, serving in combat, or taking courageous actions to save lives or property resulting in injury or harm to their health according to the conclusion of a district-level health establishment or equivalent or higher, the duration of treatment and nursing shall be included in the time for consideration for the Advanced Laborer title.
- For all employees are sent to participate in short-term training and retraining courses for less than 01 year, comply well with the regulations of training and retraining institutions, the training and retraining duration shall be included in the working time at the agency or unit to be considered for the Advanced Laborer title. In case an individual is sent to participate in a training and retraining course for 01 year or more, complies well with the regulations of the training and retraining institution, and has good learning results or higher, he or she shall be considered for the Advanced Laborer title.
- Maternity leave and leave as prescribed by law shall be included in the time for consideration for the Advanced Laborer title.
Note: The Advanced Laborer title. is not considered for one of the following cases:
- Be newly recruited or on a labor contract for less than 06 months;
- Take a leave of 40 working days or more, face disciplinary action by reprimand or more severe;
- Holders of judicial titles who commit violations and face review before agencies or units but not to the extent of disciplinary action.
What are the forms of emulation organization by the People's Courts in Vietnam?
Under Article 7 of Circular 01/2024/TT-TANDTC, the forms of emulation organization by the People's Courts in Vietnam are specified as follows:
Forms of organization of emulations
1. Regular emulation means a form of emulation based on assigned functions and tasks of individuals and collectives for the organization to launch, in order to perform well the daily, monthly, quarterly and annual work of the agency or unit.
Regular emulation applies to individuals in a collective; collectives in the same agency or unit; agencies and units with the same or nearly identical functions, tasks and nature of work.
The organization of regular emulation must clearly define specific purposes, requirements, objectives and targets and be implemented at agencies, units or emulation clusters to formulate plans, launch, sign covenants and organize the implementation of the emulation movement. At the end of the working year, heads of agencies, units and heads of emulation clusters shall summarize the emulation movement, consider or propose to consider emulation titles and commendation forms.
2. Thematic emulation means a form of emulation in order to well perform the identified key tasks within a certain period of time or organize emulation to strive to complete unexpected and urgent tasks of agencies or units.
Agencies and units shall only launch thematic emulation when clearly defined purposes, requirements, targets, contents, solutions and implementation time. When organizing a thematic emulation movement within an agency or unit, the head of the agency or unit shall guide the consideration for commendation according to its competence. For thematic emulation movements within the People's Courts with a period of 03 years or more, the Supreme People's Court shall send the plan to organize the emulation movement to the Ministry of Home Affairs (through the Central Committee for Emulation and Commendation) to summarize and guide the consideration for commendation
Thus, there are 2 forms of emulation organization by the People's Courts in Vietnam, including regular emulation and thematic emulation.
What are the regulated entities in emulation and commendation work of the People's Courts in Vietnam?
Under Article 2 of Circular 01/2024/TT-TANDTC, the regulated entities in emulation work of the People's Courts in Vietnam include:
- Units of the Supreme People's Court and Vietnam Court Academy.
- High People's Courts and Military Courts at all levels.
- People's Courts of provinces, centrally run cities and equivalents (hereinafter collectively referred to as provincial-level People's Courts).
- People's courts of districts, towns, provincial cities, and equivalents (hereinafter collectively referred to as district-level People's Courts).
- Small collectives under the above agencies and units.
- Officials, public employees, and employees (including probationers) working in the above agencies and units.
Thus, the regulated entities in emulation and commendation work of the People's Courts in Vietnam are People's Courts at all levels; collectives and units under the People's Court; officials, public employees, and employees working in these agencies and units.
Circular 01/2024/TT-TANDTC will come into force from June 11, 2024.
